Rand Paul (R-KY) and Ron Wyden (D-OR) introduced a new bull on May 19, 2021, called The Hemp Access and Consumer Safety Act of 2021. This act generally offers a legal path toward certain CBD products. As it stands, all CBD and CBD products are currently regulated by the Food and Drug Administration which is pursuant (under or to the FDCA, or the Federal Food, Dru and Cosmetic Act.
Since a CBD derivative has been now approved by the Food and Drug Administration as a drug that is being currently marketed, CBD is not able to be lawfully placed into commerce as either a dietary supplement or food at this time, as a matter of law through the FDCA.
As stated within the Hemp Access and Consumer Safety Act of 2021, CBD and CBD, products can now be added to dietary supplements or food products under the FDCA. It is important to note that all CBD products and CBD will remain subject to the specific dietary supplement or food compliance obligations that have been put in place by the FDCA.
Taken from hemp, CBD and CBD-infused products have recently expanded in their popularity throughout the United States. A recent study has estimated that the CBD market on a national level could reach a high value of as much as $16 billion by the year 2025. Even so, despite the widespread growth and heavy consumption, CBD remains unregulated in a grander sense on the federal level at the time of writing.
